Foreseeing Secret Surveillance in Social Security: Setting the Record Straight

Swiss law did not set out sufficient safeguards against arbitrary interference. The secret surveillance of activities of social-insurance claimant by private investigators hired by her insurance company is therefore unlawful, and in violation of Article 8 ECHR. The violation of Article 8 ECHR does not interfere with her right to a fair trial (Article 6 ECHR).
