The Scale Matters: The ECtHR Grand Chamber Finds That Prohibition of Mass Publication of ‘Raw’ Taxation Data Does Not Infringe Right to Freedom of Expression

Massive publication of the entire database containing ‘raw’ taxation data in a newspaper does not contribute to the debate of public interest, despite such taxation data being publicly accessible pursuant to national law. The journalistic exemption set forth in the national data protection law does not apply to mentioned publication as it is not considered to attempt solely to express information, opinions or ideas. Public access to data does not automatically imply the right to publicly disseminate the data compiled by the press.
