The effective enforcement of intellectual property rights and the claimant’s right to information in IP infringement proceedings, precludes any national provision which allows a banking institution to invoke, in an unlimited and unconditional manner, banking secrecy in order to refuse to provide information concerning the name and address of an account holder (author’s headnote).
